Woman wants husband jailed for abusive text
A woman on Friday asked a court to jail her husband who sent her an abusive text message after she refused to answer his phone call.
Ms Lydia Nkatha pleaded with Meru Chief Magistrate Evans Makori to sentence her husband Moses Muriungi to prison after he admitted he abused her. The couple which has been married for 20 years have two children.
“l am his wife but he has disturbed me for a long time. Two years ago, he burnt all my clothes. He would send me abusive texts messages whenever l refused to pick his phone call. That is why l want him jailed,” Ms Nkatha told Mr Makori who had asked if she wanted the husband freed or jailed.
The magistrate however said it was not just to sentence the accused for a mistake which the two could settle out of court adding that their children were likely to suffer as a result.
DIVORCE SUIT
But when Ms Nkatha remained adamant, the magistrate advised her to file a divorce suit instead.
“It would be prudent for you to file a divorce suit in this court rather than having your husband whom you had been living with for 20 years jailed,” said the magistrate.
Muriungi is accused of sending his wife an abusive text message on November 19 at Chugu village in Imenti North Sub County.
In mitigation, the accused told the court their children will have no one to educate them if he is jailed. He claimed to have asked for forgiveness from his wife who refused and instead reported the matter to Giaki Police station.
Muriungi said his wife had a tendency of not picking his phone calls and he suspected her of infidelity. The accused will remain in remand until December 1 when a probation report will be presented in court.
