Waititu pleads with court to dismiss Kidero victory
Former Embakasi MP Ferdinand Waititu has asked a court to declare Nairobi Governor Evans Kidero’s election victory as a sham.
But the governor in a rebuttal said Mr Waititu’s appeal was belated and that he was resurrecting issues that were in the main petition that declared Dr Kidero validly elected.
The two political rivals shared the same bench in a packed court, sitting inches away from each other but barely looking at each other as their lawyers argued out the case.
The two leaders did not even shake hands after the three hour Court of Appeal sitting.
Nairobi senator Mike Sonko accompanied Mr Waititu with a handful of supporters while Kidero’s team pensively followed the proceedings.
“The time has come for the scales of justice to be tilted with the demand from Nairobians that a declaration that fresh elections be held for the county,” lawyer Paul Muite said in his closing submissions.
But lawyer Tom Ojienda for Dr Kidero said Mr Waititu was asking the court to adjudicate on “facts and not matters of law as is required of appeal cases,” he said.
The judgement will be delivered on May 16, 2014.
