By PHILIP MUYANGA November 14th, 2013 1 min read

Three soldiers were on Thursday charged with robbery with violence.

Mr James Mbaji Nzaka 24, Mr Kelvin Murithi Ntinda 27 and Mr Jackson Nthenge Willy were attached to the Kenya Defence Forces Karen Barracks when they committed the offence.

The court heard that on November 7 this year in Ngong Town, they robbed Mr David Miano Wangui of car valued at Sh400,000 while armed with a Browning pistol.

They also robbed Ms Janet Gesare of Sh50,000 at Elpaso area, it is alleged.

Mr Nzaka denied illegal possession of a firearm and ammunition.

The police arrested all the men on November 7, but moved to court the following day seeking more time to hold them in custody to complete investigations.

According to military discipline, an officer or soldier who commits an offence while in service is stripped of his rank and sacked immediately.

The three suspects were sacked on November 9.

Their lawyer, Mr Gikunda Anampiu, said that the suspects where “serving military officers whose jobs were at stake” and asked that they be freed on bail.

The prosecution opposed bail arguing that they were facing a capital offence.

But Kibera Principal Magistrate Bernard Ochoi ruled that the prosecution did not provide compelling reasons to deny them bail and released each on Sh1 million bail with surety.

The case will be heard on January 4 next year.
