Suspects claim they were ‘cut’ while in remand


Three men and a minor facing a murder charge on Tuesday told a high court that they were circumcised while being held at Industrial Area remand prison.

Jacob Odhiambo, Wycliffe Odhiambo, George Opiyo and the minor said they were circumcised against their wish.

“Genitals of the accused are oozing blood, others are not doing any better. We request they be taken to hospital to get adequate medical attention, the wounds are becoming septic. Somebody can lose his manhood,” their lawyer Mr Perez Odero told the court.

The accused allegedly on January 23 this year at Bidii area near Kayole police station murdered Mr John Owich.

Mr Perez, who made an application to have the accused taken to Kenyatta National Hospital, told Ms Lady Justice Roseline Korir that they will revisit the matter once they have relevant information.

The court also heard that  the accused were assaulted at Kayole police station moments after their arrest.

According to the prosecution, a report confirming whether there was the alleged assault and circumcision ought to be availed by the officer in charge of Kayole police station and prison authorities respectively.

The judge directed all the accused be taken to Kenyatta Hospital and a report to be presented to court during the mention date.

Ms Korir also directed that the minor be held at the juvenile wing of the Industrial Area remand prison.

She also directed the officer in charge of Kayole police station to prepare a report to be presented by the prosecuting counsel.

The case has been fixed for mention on March 11.
