Sacked county executive Ondieki now sues Kidero


Former Environment minister Nairobi county, Mr Evans Ondieki has claimed that the recent decision to sack him was unlawful and irrational hence the need for the court to nullify the same and reinstate him.

In court papers filed on Monday, Mr Ondieki said that Governor Evans Kidero had acted emotionally and arbitrarily in making the decision to sack him because of a belief that he (Mr Ondieki) was supporting his opponents.

RE-ELECTION

He cited a special county executive committee meeting held on January 26, which had proceeded well, until Governor Kidero started talking about his re-election in 2017 and started shouting at Mr Ondieki for associating with potential candidates.

“He said I was associating with former Devolution Cabinet Secretary Anne Waiguru and others, but I told him that the constitution allows freedom of politics and association,” Mr Ondieki.

Mr Ondieki was dismissed from his post as the County Executive Committee member in charge of Environment, Water, Energy, Forestry and Natural Resources on January 26.

He said the decision to dismiss him was made unlawfully as it did not conform with the constitution, Employment Act, and County Government Act.

Further, that he was not given an opportunity to defend himself.

PERFORMED DILIGENTLY

Mr Ondieki said he has always performed his duties and responsibilities in a diligent manner and there has never been a complaint raised about his performance.

Further, he has never been warned that his performance was below expectation and therefore the Governor had a duty to act reasonably and in good faith.

He wants the county government stopped from appointing anybody to his former docket until his case is heard and determined.

Mr Ondieki was first appointed on October 10, 2013 as the county executive committee member for roads, public works and transport before being moved to the environment docket in October 2014.
