Sex pest to serve 20 years for defiling and impregnating 13-year-old
A 22-year-old man was on Friday sentenced to serve 20 years in prison by a Narok Court after he was found guilty of defiling a 13-year-old girl and impregnating her.
Benjamin Cheruiyot Langat committed the offence on diverse dates between December 2017 and August 2018 at Ngiito village in Narok West Sub County within Narok County.
He also faced an alternative charge of indecently assaulting the minor by touching her private parts but this charge expired after he was convicted of the main charges of defilement, in accordance with the law.
The court was told that the accused who was a neighbour, lured the girl to his house several times and defiled her and the matter was only discovered when the girl got pregnant.
In her judgment, Narok Chief Magistrate Ms Wilbroda Juma said the prosecution had proved the case beyond reasonable doubt. She said the facts of the case were well-corroborated and did not leave any loose ends.
The magistrate said the girl, though a minor, had consistently and meticulously narrated to the court how the accused waylaid and dragged her into a bush and defiled her.
“I find that the girl’s testimony in court to be truthful and that she was not coached to lie against the accused, and that the paternity (DNA) test had proved the accused is the one who fathered the complainant’s child,” the magistrate said.
In his defence, Lang’at had denied the charges claiming that he was framed by the complainant’s parents because of an old grudge.
But the magistrate tore into this defence saying it did not punch holes into the prosecution evidence.
In mitigation, he pleaded for leniency saying he was the sole breadwinner of his parents and siblings.
The magistrate said she noted the mitigation but the law seeks to protect young innocent girls from sexual exploitation by people like the accused.
The magistrate reminded the accused of his right of appeal within 14 days.
