Peter Kenneth son’s fatal accident witnesses summoned after skipping court session

A Kibera court on Monday summoned two witnesses in a case against one-time Nairobi gubernatorial aspirant Peter Kenneth’s son.

Andrew Kenneth has been charged with causing death through dangerous driving.

The witnesses, a motor vehicle inspector and a doctor, skipped a court session although they were duly bonded, the prosecution said while applying for the summons.

“We have the bonds duly signed by the witnesses committing to appear in court today. However, none is in court. I ask the court to summon the said witnesses,” the prosecution told Senior Principal Magistrate, Joyce Boke.

In the case, Andrew Kenneth has denied causing a road accident at Waruku, Kangemi on January 11 2017 in which Kennedy Sijei Kachuan died.

DIED ON THE SPOT

According to the charge sheet, the accused was driving a Lexus when he is alleged to have committed the accident.

Sijei died on the spot, according to his widow, Esther Nduku, who testified last year.

She told the court that she received a call from the police informing her that her husband had been involved in a road accident at the junction of Waiyaki Way and Musa Gitau roads.

“I went to the scene and saw the body of my husband on the side of the road. There was a vehicle… police told me he was dead and they were searching for his leg,” Ms Nduku, a mother of three, told the court in her testimony.

The court heard that the deceased was waiting for traffic to clear so as to cross the road. Ms Nduku said that her husband had spent the night at their house in Kangemi.

The magistrate adjourned the case to October 23 when the summoned witnesses are expected in court.
