ODM nomination loser wants to be compensated Sh15M
An aspirant who lost the Orange Democratic Movement party’s nomination for the Vihiga Parliamentary seat wants to be compensated Sh15 million for losses he allegedly incurred while preparing for that exercise.
Mr Christopher Amasava has sued ODM, the Vihiga constituency’s returning officer and the party’s National Elections Board.
The Independent Electoral and Boundaries Commission is listed as an interested party in the suit.
Ms Amasava who lost to Ms Dorcas Kedogo, in his case documents claimed that the outcome of the exercise was predetermined on who was to be the winner.
The Nairobi resident argued that since he is an ODM life member, that he met all requirements set down for the nomination exercise as well as paid the requisite fees yet the exercise was tainted with irregularities, he needs to be compensated.
“An order be directed to the sued parties to pay me a sum of 15million shillings as damages for losses incurred in preparation for the party primaries,” said his lawyers from the firm of Khaminwa and Khaminwa advocates.
He also wants ODM ordered to award him the party’s certificate for the Vihiga Mp’s seat and that the disputed nomination exercise results be nullified.
He further wants his opponent Ms Kedogo to be barred from participating in the primaries again if a repeat is done.
According to Mr Amasava, he claimed that the County’s election board was single-handedly handpicked without informing the branch office and that there were ghost polling stations.
He alleged that the National Elections Board has refused to respond to his petition in which he had sought a nullification of the April 25 ODM nomination exercise.
He also alleged that he was not informed where the tallying centre would be yet he was an aspirant.
“I verily believe that the said decisions to the extent that they were reached without affording me the right to be heard, violated rules of natural justice and cannot stand,” said Mr Amasava.
