Moi’s son saved from paying ex-wife Sh90m in messy divorce

A son of retired President Moi’s son, Philip, got a respite Thursday after the Court of Appeal excused him from paying his ex-wife Sh90 million.

Appellate judges Martha Koome, Mohammed Warsame, and Philomena Mwilu said Mr Philip Moi  does not have to pay Ms Rossana Pluda a Sh30 million lump sum and a house in Runda, Lavington, Kileleshwa, Kilimani, Karen or Sh60 million alternatively.

He had been told to pay by the High Court. He appealed.

The judges Thursday said he does not have to pay anything until his appeal is heard and concluded.

They however ordered Mr Moi to continue paying Ms Pluda Sh150,000 monthly maintenance and any accrued balance.

High Court Judge Luka Kimaru in March ordered Mr Moi to pay Ms Pluda a lump sum of Sh30 million after the two agreed to dissolve their marriage.

Mr Moi’s lawyer, senior counsel Tom Ojienda however, appealed the judgment, arguing that he could not to raise the amount.

Prof Ojienda told the judges that Mr Moi was providing for the entire upkeep, education, medication, clothing, entertainment, housing and all other needs of their two children.

He said paying his former wife the amount would be a burden he could not carry.

The case will be heard on October 16.
