Kidero given 21 days to respond to election suit

Embattled Governor Evans Kidero has three weeks to respond to an appeal seeking to reverse his election victory.

The Court of Appeal on Tuesday ordered former Embakasi MP Ferdinand Waititu to serve all the parties mentioned in his case.

Through lawyer Harrison Kinyanjui, he told the court that High Court judge, Richard Mwongo erred in law when he ruled against him in September.

He said that the judgement read by the judge differed from the one that was written.

“The appellant is dissatisfied with the entire judgement and  of  justice Richard Mwongo,” he said.

Mr Waititu said he could not serve all the parties to the dispute as they where caught up in the New Year festivities.

He has named Dr Kidero, the IEBC, its chairman Issac Hassan, the Nairobi county returning officer,  the Attorney General , the DCIO Gigiri police division, DCIO Kayole police division, the Inspector general of the national police service and a Mr Jonathan Mweke, Deputy Governor as respondents.
