High Court suspends new rules on instant traffic fines

The High Court on Monday suspended regulations on minor traffic offenses which were recently effected.

Lady Justice Roselyne Aburili has ordered that the regulations that introduced instant fines on minor traffic offenders to stop being implemented temporarily.

A matatu trade union, known as the Kenya National Union Cooperative Staff, had last week moved to court to challenge the regulations which were gazetted on September 23 and are being enforced by the National Transport and Safety Authority (NTSA).

Through lawyer George Miyare, the Union sued NTSA and Transport Cabinet Secretary James Macharia claiming that the regulations violated the rights of those in the matatu business to a fair trial.

The judge has ordered that enforcement of the said regulations be immediately stopped pending the hearing and determination of the case.

The regulations had introduced instant fines ranging between Sh500 and Sh10,000 for minor traffic offences.
