Court bars eviction of billionaire’s children from Hurlingham apartments
The first family of billionaire Stephen Kung’u was Wednesday barred from evicting his three grown children from a Hurlingham apartment in Nairobi they have lived in for decades.
Lady Justice Janet Mulwa also ordered Mr Kung’u’s first wife, Ms Grace Nyambura, and her four children who manage enterprises worth over Sh50 billion to ensure no property is “ruined” or alienated until the matter over the estate’s distribution is heard and determined.
Mr Kung’u died on April 6 this year.
Lawyer Tom Ojienda had told the court that the first family influenced the eviction of Ms Naomi Wambui Kung’u and her sisters Rahab Wamucii Kung’u and Bilha Wanjiku Kung’u from the palatial house owned by the billionaire.
FORCEFULLY EJECTED
The court also heard that Ms Wamucii was forcefully ejected from Monte Carlo Club, which she managed before Mr Kung’u’s death, before it was closed down.
She was later escorted to Central Police Station where she was locked up but was released after her lawyers intervened.
Prof Ojienda said the second family was concerned that the first family wanted to transfer all properties to themselves, denying them a share of their father’s estate.
Their mother, Ms Joyce Wanjiru, died in 2009.
Earlier, the three protested that there were plans to change signatories and registered directors of various companies.
MASSIVE WITHDRAWALS
“You visited all our father’s residential estates as well as businesses before proceeding to the Registrar of Companies seeking to alter the registered entities. You attempted to make massive withdrawals and transfers from his various bank accounts,” they assert.
They urged their stepmother, stepbrothers and sisters to take out a letter of administration to allow them benefit from the estate as they did when he was alive.
Lady Justice Mulwa directed that the petition to safeguard the estate be heard on October 7.
