City woman claims husband framed her in Sh1 million theft case


A woman stunned a magistrate on Thursday when she claimed that the complainant in a Sh1 million theft case was her husband who had battered her in the past.

Ms Rosalyn Wangui Wambugu had appeared in a magistrate’s court charged with forging account opening forms of Jondu Enterprises Limited at the National Bank of Kenya on April 16, 2018.

She also faced a second charge of stealing Sh1 million from the company on March 29, 2018.

The charge sheet lists her as a director and employee of Jondu Enterprises Limited.

However, drama unfolded inside the courtroom at Milimani in Nairobi when the accused wailed uncontrollably claiming that John Ndung’u Njau, the complainant in the case, was her husband and that he had framed her.

She also told senior principal magistrate Martha Mutuku that she was a victim of domestic violence.

“I wish to bring to the attention of this court that I am a victim of domestic violence. I am a battered woman. My husband who is a director of the family company is the complainant in this case. He has on a many occasions subjected me to unnecessary beating and he is behind this case,” Ms Wambugu told the magistrate amid sobs.

At this point, the magistrate sought confirmation that John was her husband.

“Yes, Mr Njau is my husband and a director Jondu Enterprises Limited, the complainant,” said Ms Wambugu.

The prosecution and Mr Njau –who was not in the courtroom- did not challenge her claims.

She pleaded with the magistrate to release her on a reasonable bail to enable her fend for her two children.

State prosecutor Pamela Avedi did not object to her request to be released on bail and the magistrate released her on a cash bail of Sh100,000.
