A 27-year-old woman was sentenced to 10 years in prison for killing her four-year-old daughter while her husband was let off the hook over the same offence.

Jane Gathigia Maina and her husband Walter Njuguna Njoroge had been accused of killing baby Anastasia Njoroge on October 3, 2010 at Wangige Market in the outskirts of Nairobi.

Justice Nicholas Ombija found her guilty of strangling and suffocating her baby before dumping her in a well.

The judge ruled there was no way the child could have thrown herself in the borehole in the middle of the night unless it was done by the mother, who went out with the child on the fateful night.

“Having considered and evaluated the evidence on record, I find the first accused guilty as charged for killing her daughter. But considering her mitigation and the fact that she is a young lady nursing another child she had while in custody, I will sentence her to 10 years in jail,” ruled Justice Ombija.

He said there was no evidence linking her husband to the murder.
