MP Simon Mbugua, two others face robbery with violence charges over goon attack

A member of the East African Legislative Assembly (Eala), Mr Simon Mbugua and two others are facing charges of robbery with violence  in connection to last week’s assault on a businessman.

The charge attracts a maximum sentence of death penalty.

The three were arrested on Tuesday at the Sagret Hotel in Nairobi.

They have been linked to the assault of Nairobi Central Business District Association member Timothy Muriuki as he addressed the media at the Hotel Boulevard on Monday last week.

The charge sheet states that the three, jointly with others not before the court, robbed Mr Muriuki of Sh100, 000 at Hotel Boulevard.

They are also accused of injuring Mr Muriuki after the alleged robbery.

WITNESSES

Prosecution has listed seven people as possible witnesses.

Police had on Sunday announced that; “The suspects whose images are attached are wanted by Police to answer to charges of robbery with violence. The suspects who have since gone to hiding attacked and robbed Mr Timothy Muriuki at Boulevard Hotel on 30/04/2018. A cash reward of Sh500,000 will be offered to anyone with information leading to their arrest.”

Section 297 (2) of the Penal Code dictates that “if the offender is armed with any dangerous or offensive weapon or instrument, or is in company with one or more other person or persons, or if, at or immediately before or immediately after the time of the assault, he wounds, beats, strikes or uses any other personal violence to any person, he shall be sentenced to death.”
