Triumphant Miguna dares government to appeal court decision


Exiled lawyer Miguna Miguna has dared the government to appeal the High Court ruling which awarded Sh7 million on Friday as compensation for violation of his rights through deportation to Canada.

While responding to a tweep, who wondered if the government would appeal the court ruling, the fiery lawyer curtly replied, “Let them try.”

Miguna further expressed hope of an even greater compensation if an appeal is filed by the government at the Court of Appeal.

“The Court of Appeal will increase my damages by 200%. Let them try. They will not win on earth, in hell or in heaven! #SayNoToUjinga,” he tweeted.

Miguna in a press statement, released shortly after Friday’s ruling, said he will be back in the country and thanked his legal team for their great job.

“I extend my gratitude to those few genuine and dedicated advocates like Dr John Khaminwa, Waikwa Wanyoike, Stephen Ongaro and the KNHRC senior officer Kamanda Mucheke plus all patriots and comrades who stood with me throughout,” he wrote.

In Friday’s ruling, Judge Enoch Chacha Mwita said Mr Miguna’s deportation was unlawful and in violation of the Constitution.

Concerning Mr Miguna’s passport, Justice Mwita said its cancellation and the declaration that he was a prohibited immigrant was unconstitutional.
