Man fined Sh100,000 for sending abusive SMS

A Nyahururu court Monday fined a middle-aged man Sh100,000 or serve one-year in jail in default for sending two threatening and abusive messages to a woman.

Samuel Njenga, who appeared before Nyahururu Principal Magistrate Dennis Mikoyan, pleaded guilty to the charges.

He was charged that on October 7, 2011 at around 7:25 p.m., in an unknown place while using a Safaricom line, he sent a threatening and abusive text message to Mary Wanjiku Mwaniki of which some parts read: “Stop talking what you don’t know, go and visit a witchdoctor and bewitch me…”


A second count stated that five minutes later on the same day at an unknown place, the accused sent another text message to the complainant that read ‘… Mary Mwaniki, we sleep together with you on the same bed, you are the source of your husband’s death! I have been sent to steal your money…”

The court heard that the complainant reported the matter to Ng’arua police station after receiving the two text messages from a known number and investigations commenced.

The court further heard that the accused fled to an unknown destination on learning that police were searching for him.

However, police on May 2, this year arrested him at Ng’arua Township in Laikipia County and opened charges against him. He was given 14 days to appeal. He had not raised the fine by Monday 5 p.m.
