Man who had vasectomy sues Marie Stopes after wife got pregnant

A man in Mombasa who underwent a vasectomy now wants a hospital to explain how his wife still ended up getting pregnant with his sperm.

Mr Samuel Gatenjwa wants Marie Stopes Kenya Limited and a doctor to tell him why he is still fertile despite undergoing sterilisation.

Vasectomy is a surgery that involves cutting or blocking off the sperm duct so that sperm cannot leave the male during sex.

In his court papers, Mr Gatenjwa says that the team of doctors who performed the vasectomy, led by one Dr Igogi, had assured him that everything about the vasectomy  according to plan.

‘CONTRACEPTIVES’

Mr Gathenjwa says he opted for vasectomy because his wife was experiencing “unpleasant health side effects as a result of taking contraceptives.”

In its response, the hospital and the doctor said they did not make an express warranty to their patient that the procedure would be a success.

“We admit carrying out the procedure on the plaintiff as alleged but we did not inform the plaintiff that the operation was a success as he alleges,” the hospital said.

The hospital said that it never asked him to undergo the vasectomy that allegedly happened in March 23, 2004. It said that he did it voluntarily and wants him to prove otherwise.
