Man to rot in jail for life for defiling minor, infecting her with HIV virus


A 39-year-old man has been sentenced to life in prison for defiling an eight-year-old girl and intentionally infecting  her with HIV virus in Eldoret town.

Jackson Kones Nangiro was accused that on January 3, 2016 at Vumilia ‘A’ village in Eldoret West District within Uasin Gishu County unlawfully and intentionally defiled the minor and infected her with HIV virus.

The accused, who was also charged with indecent act, was released on a bond of Sh100, 000 after pleading not guilty to the offence.

BEYOND REASONABLE DOUBT

However, Eldoret Principal Magistrate Charles Obulutsa on Monday ruled that the prosecutor had proved to court beyond reasonable doubt that the accused committed the offence.

“The prosecution has proven beyond reasonable doubt that the accused defiled the girl. The accused has 14 days to make an appeal, ruled Magistrate Obulutsa.

The prosecutor told the court that one of the witnesses found the accused in bed with the girl and alerted neighbours.

The court heard that the accused used to work for the girl’s mother as a farmhand.

After the incident, the girl’s mother noticed her daughter was bleeding profusely from her private parts and had difficulty in walking.

She rushed her to Moi Teaching and Referal Hospital (MTRH) for examination and treatment.

MEDICAL REPORT

The magistrate noted that a doctor’s medical report indicated that the minor had been defiled.

“From the medical reports presented in court said discharge was found and the girl’s hymen was broken, an indication she had been defiled,” the magistrate said in his ruling.

The accused pleaded with the magistrate for leniency saying that he lost his wife some years back and that his three children depend on him.

But the magistrate reminded the accused that his action has damaged a young girl’s future by infecting her with HIV virus and that he does not deserve mercy.
