Kenyan couples to seek Govt permission before marrying under customary law – AG


Kenyan couples seeking to marry in accordance to their traditional customs must henceforth seek authorisation from government before proceeding into marriage life.

Couples already married under customary law must also register their marriages with the Registrar of Marriages and obtain certificates of the same.

These are part of new the Marriage (Customary Marriage) Rules, 2017, that take effect from August 01, 2017.

Attorney General Githu Muigai, in a gazette notice, said couples marrying under customary law must from August 1 get prior authorisation from the Office of Registrar of Marriages.

“Marriage certificates shall be issued to parties upon successful application. The operative date has been fixed for 1st of August 2017,” Prof Muigai said in the gazette notice.
