High Court disbands city water board


The Nairobi Water and Sewerage Company’s 11-member board has been dissolved after a court ruled that the members were in office illegally.

In a judgment delivered at the High Court on Thursday, members of the board were ordered to vacate office and the vacancies advertised for fresh competitive recruitment.

Nairobi Governor Evans Kidero was found guilty of “single-handedly” constituting the board when the tenure of the team that was led by Mr Peter Kuguru ended.

He had appointed as chairman Mr Raphael Nzomo, whose ascension to office raised eyebrows on grounds that it was unconstitutional.

Activist Okiya Omtata lodged a petition challenging the appointments early this year.

“This is a company that was formed using public funds and limited to serve the interests of the public.

“The county government and governor are only trustees, and cannot dictate its directorship,” Lady Justice Mumbi Ngugi said in her judgment.
