Fake doctor Mugo Wairimu’s rape case aborts

The trial of James Mugo Ndichu, alias Mugo Wairimu, over the alleged rape of a sedated woman at his clinic in Githurai was adjourned Monday over missing witness statements.

The suspect told a court that he was not ready to stand trial because the prosecution had yet to “avail” the statements of witnesses in the alleged offence.

He is charged with rape and multiple counts of operating unlicensed clinics and practicing without authority.

Wairimu was arrested in September last year after a sensational video clip showing a man sexually abusing a sedated woman in a hospital bed went viral and sparked public outrage on social media.

The case had initially been delayed as the police, through the DPP, sought “more time” to complete investigations.

“It is the responsibility of the accused person to collect witness statements from the police ,” argued Ms Jacinta Nyamosi while objecting to a request for adjournment from the suspect’s lawyer.

The senior state counsel told the court that police had completed their investigations and all statements have been compiled.

The prosecutor confirmed that the two key witnesses, who were yet to record their statements and who were outside the Nairobi, had since been reached.

Initially, investigating teams had been awaiting statements from University of Nairobi, where the suspect studied, and the government analytical laboratory in regards to DNA extractions and other undisclosed samples that were picked from the various clinics he operated.

The suspect has denied raping a female patient whose name cannot be disclosed due to legal reasons.

On Monday, the trial court extended his Sh 1 million bond to January 28, 2016 when the proceedings are scheduled to resume.
