Ex-MP Gumo’s son in court for causing death in road accident


Former Westlands MP Fred Gumo’s son, Magero Gumo on Wednesday objected to prosecution’s bid to have a traffic case he is accused of killing a senior prosecutor through dangerous driving commence before a Kibera court.

Magero told the court that he could not proceed with the case in which he is charged with causing the death of Victor Kabaka without documents the police had declined to give him.

“I am not ready to proceed with this case. I have not received the witness statements and documentary evidence the prosecution will use,” he said through a lawyer.

Two witnesses were in court ready to give evidence.

Magero told the court that efforts to get the documents from the police were futile.

DRUNK DRIVING

“We were told they were not ready,” he stated.

In the case, he is accused of causing an accident on Waiyaki way on April 3 this year that led to the death of Kabaka who was a deputy director of prosecution attached to Milimani law courts.

Kabaka died while undergoing treatment at the Nairobi hospital. Court documents indicate that Magero was drunk when the Land Cruiser he was driving collided with Kabaka’s car.

He is also facing a charge of driving under the influence of alcohol and five other counts of causing injuries to passengers who were in a matatu involved in the accident.

On Wednesday, Magistrate Shadrack Mwinzi ordered the police to supply him with all relevant document to prepare for the case that will be heard on October 7. Magero is out on Sh200,000 cash bail.
