Judge suspends increased parking fees

Nairobi High Court Judge Isaac Lenaola has suspended the increased parking fees pending the determination of an appeal by matatu saccos.

Motorists with saloon cars will now pay the normal Sh 140 instead of the proposed Sh300 for parking within the Central Business District.

Justice Lenaola suspended the increased parking fee after matatu saccos filed a notice of appeal against a judgment that had approved the increment.

The Judge had on Wednesday approved the increased parking fee on grounds that the court cannot direct the Nairobi county government on how to exercise its duty of levying parking fees.

City motorists can breathe a sigh of relief after a judge suspended the execution of parking fees increment by the city government.

In granting the stay orders on Thusrday, Mr Justice Isaac Lenaola said he is aware that the matter involves the power of devolved governments and their assemblies.

“The law in that regard is both new and untested, such law will only be settled in higher courts than this one,” said Mr Lenaola.

Through lawyer Harrison Kinyanjui, the Saccos claim that their intended appeal to the judgment has overwhelming chances of success.

“The applicant has an arguable appeal which will be rendered nugatory if there is no stay of execution,” read the application.
