Court told to convict suspects in bloody murder of Uhuru’s kin


A court has been asked to convict the suspected killers of a relative of President Uhuru on grounds that they were positively identified in connection with the fatal shooting and alleged gang rape at the lawyer’s city residence.

The suspects will know their fate on August 19 when the trial court in Nairobi is set to deliver judgement.

They have been tried for three years for robbing and killing the late lawyer Rose Waruinge at her home in Kilimani, Nairobi.

Senior principal magistrate Lawrence Mungambi fixed the judgment date after the prosecution and defence completed their submissions on Thursday.

The suspects asked the court to acquit them saying the prosecution had failed to link them to the offence.

They claimed that when the lawyer’s home was invaded they were separately at their respective work stations and were therefore being accused of offences they know nothing about.

But the prosecution maintained that there “is enough evidence connecting the accused persons with the charges prefered against them by the case investigating officers Mr John Shegu.”

Mr Paul Kilyungi Maluki and Mr Mutua Nzioka, Mr John Masila Nzioka, Mr Alex Mwenda and Mr Aggrey Musina have denied violently robbing the lawyer before shooting her dead at her Kilimani, Nairobi.

They face the death penalty if convicted.

Among the witnesses who testified inclueed a son and two daughters of the deceased who were present during the attack.

Police officers including Mr Shegu testified that the robbers shot the lawyer in her breast and sexually
molested her other female guests in the February 10, 2012 incident.
