Cord blocked from Kidero, Shebesh slap case


High Court has declined an application by Coalition for Reforms and Democracy (Cord) and the Nairobi County government seeking to be enjoined in an assault case against Nairobi Governor Evans Kidero.

Judge David Majanja said that no political party is supreme to the other, adding that it will impose unnecessary costs to the party.

He also said that the case was a criminal proceeding which involves individuals and not their offices or titles.

The judge further said that both Cord and the Nairobi County government which were seeking to be enjoined in the case have not sufficiently convinced the court on why they should be enjoined in the case.

He however directed that the separate applications filed by Nairobi Governor Evans Kidero and Nairobi Women representative Rachel Shebesh be consolidated for the hearing on February 7, 2014.

“I also extend orders stopping the police from arresting and charging Dr Kidero and Ms Shebesh with the various charges until the application they have filed before court is heard and determined,” said Mr Justice Majanja.

The Director of Public Prosecution has recommended that Dr Kidero be charged with assault, while Ms Shebesh is to be charged with creating public disturbance.
