City lawyer charged for unlawful practice

A city lawyer whose name has been struck from the roll of advocates was on Friday released on a cash bail of Sh50,000 after being charged with practising yet he is unqualified.

Daniel Ndung’u who allegedly has been conning member of the public money while accepting to represent them in court cases yet he knows he is not allowed to do so, denied two counts of charges relating to acting as an advocate while unqualified before Principal Magistrate Joseph Karanja.

He was arrested on Thursday and remanded at Parliament Police station before being arraigned in court yesterday.

Prosecution told court that the accused twice appeared before a Milimani High Court judge on December 29, 2014 and on January 8.

Mr Ndung’u pleaded not guilty to the charges. His case will be heard on January 23.

Meanwhile,  two friends were released on a Sh200,000 cash bail after denying raping a 23-year -old woman with whom they had shared a drink.

Stephen Dimolo and his friend Joseph Gikunju Muriuki denied raping the woman on January 4 at Loresho drive in Nairobi’s Westlands Loresho Mukabi drive.

ASSAULTED

The prosecution told the court that the accused persons allegedly committed the offence between the night of January 3 and morning of January 4.

The court heard that the accused persons together with the assaulted woman had gone for a drink at a city joint and moved to another before proceeding to Dimolo’s house.

The accused persons were to help the assaulted woman make a phone call in order to get a taxi to take her to her house but instead allegedly raped the woman at Dimolo’s house.

The assaulted woman had allegedly pleaded with Muriuki to let her go after Dimolo had fallen asleep but he instead threatened to kill her and only freed her after also raping her.

Both Dimolo and Muriuki were charged with an alternative charge of committing an indecent act with an adult.

They both denied the charges before Principal Magistrate Joseph Karanja being released on a cash bail. Their case will mentioned on January 23.
