Charge sheet had listed Miguna as ‘Kenyan’ hours to deportation


The Kenya Police had listed Nasa activist Miguna Miguna as “Kenyan” hours before he was ejected from the country on claims that he had denounced his citizenship.

Miguna was arraigned before a judge in Kajiado on Tuesday morning where he was charged with treason.

But curiously, the charge sheet drawn by the police said Miguna was Kenyan.

“Being present and consenting to the administration of an oath to commit a capital offence namely treason contrary to section 59(a) of the penal code,” read the charge sheet in part.

“On the 30th day of January 2018 at Uhuru Park in Nairobi county, jointly with others not before the court, were present and consented to the administering of an oath to Raila Amollo Odinga purporting to bind the said Raila Amollo Odinga to commit a capital offence treason.”

But on Tuesday night, the lawyer was put on a KLM flight destined for Canada.

Later, Interior ministry spokesman Mwenda Njoka said the lawyer had denounced his citizenship and never bothered to reclaim it.

“Mr Miguna denounced his Kenyan citizenship years back, acquired Canadian citizenship and never bothered to reclaim Kenyan citizenship in the legally prescribed manner neither did he disclose that he had another country’s citizenship despite being a lawyer who should have known better,” Mr Mwenda said on Twitter.

Miguna was one of the lawyers who administered the oath to Odinga on January 30 at the Uhuru Park, Nairobi. Odinga is, however, a free man.
