Blogger Nyakundi gets 10 days to exonerate himself in Collymore defamation suit
Controversial blogger Cyprian Nyakundi has been given up to the end of the month to justify his continued defamation of Safaricom boss Bob Collymore before appropriate punishment against him can be taken.
The High Court in Nairobi has further directed Nyakundi to file a sworn statement and provide copies to Collymore lawyers who complained that the blogger has deliberately disobeyed court orders restraining him from publishing offending articles on social media on December 1, 2016.
Collymore lawyers claimed that Nyakundi has repeatedly posted tweets on his personal platform in total disregard of court sanctions.
The Safaricom CEO wants orders to have Nyakundi jailed for disobeying an injunction issued on July 18, 2016, blocking him from publishing defamatory articles concerning corruption in the media industry in Kenya.
CONTEMPT OF COURT
In December 2016 he was found guilty of he was found guilty of to have acted in contempt of court for publishing information about a mobile telecommunication company’s boss while attacking the media industry.
Nyakundi on his part, claimed that it was unprocedural to introduce new evidence on a matter that was pending adjudication.
The dispute started back in June 2016 when Mr Collymore and his predecessor Michael Joseph sued the blogger for publishing defamatory statements about them.
It is this article that prompted the two to drag the matter to court again with Mr Collymore claiming that he has suffered substantial damage to his reputation owing to the blogger’s disparaging view of him in the said piece.
The Judge extended the sanctions imposed on Nyakundi to keep off commenting about the contentious issue pending his mitigation and sentencing.
