The scramble by businesses at the city to attract more customers though illegal outdoor advertisement will now attract a fine of up to Sh50,000 if a proposed law at the county assembly is passed.

The Bill titled Nairobi City County Public Nuisance Bill 2016 will see businesses who shout,use any bell,gong or other noisy instruments or loud speaker penalized.

The Bill seeks to tackle common nuisances mainly in fast food outlets and dine-in restaurants,electronic shops,hawkers,touts notorious for fighting for the customers by competing who is the loudest.

“Any person in any street without a permit for the purpose of hawking,or otherwise outdoor advertising any article or event shouts or uses any bell,gong or any noisy instrument shall be punishable with a fine not exceeding Sh50,000,” says the Bill sponsored by Viwandani MCA Samuel Nyangwara.

If passed the bill will also see the acrobat on stilts who mainly distributes hand bills and other papers for the purpose of outdoor advertising without a permit fined.

The bill proposed will also see anyone who throws a banana or orange peels jailed for the purpose of an offence likely to cause a person to fall down.

The Bill will also prescribe measures for waste, insects and pests.

“The objective of this Act is to provide for the control of public nuisances, including waste and disease-causing pests; and in order to ensure a clean and healthy environment,” states the Bill.

The bill will also punish those who defecate or urinate on the streets.

Failing to observe traffic lights and zebra crossings or motorist who jump lights will also risk being hauled to City Hall court.
