Deputy CJ Rawal loses battle to remain in office


Deputy Chief Justice Kalpana Rawal has been ordered to proceed to retirement after the Court of Appeal ruled that she had attained the retirement age.

The seven judges of the court ruled on Friday that retirement age of all judges is 70.

The deputy Chief Justice, through lawyers George Oraro and Kioko Kilukumi, had moved to court to argue that she is supposed to retire at the age of 74 years and not 70 as stipulated in the constitution.

She argued she was appointed under the old constitution which set the retirement age of judges at 74.

The Judicial Service Commission had served Justice Rawal with a retirement notice and invited suitable candidates to apply for her position.
