Court declines to issue contempt orders against Cord principals
High Court judge Joseph Onguto on Monday declined to issue orders citing Cord leaders Raila Odinga,Kalonzo Musyoka and Moses Wetangula for contempt.
Even though the judge certified the matter as urgent, he has ruled that he cannot issue such orders as at now since there is no evidence placed before him indicating that the Cord leaders cannot be traced so that they can be presented with case documents.
Lawyer Harrison Kinyanjui, acting for Jubilee MPs, had told the court that Cord leaders had twice failed to appear in court or participate in the case.
Mr Kinyanjui also pleaded with the judge to include Senator James Orengo as a party in the contempt of court proceedings because he represented the Opposition at one time in the case and was present when orders barring them from storming into IEBC offices were issued.
The judge agreed to include Mr Orengo in the contempt of court proceedings.
The judge also directed that video facilities will be used in court during the hearing of the case because the Jubilee MPs said they would want to present evidence to show how Cord leaders have acted against court orders and in violation of the law.
High Court judge Isaac Lenaola had initially issued orders stopping the opposition from storming into IEBC offices, but had not barred them from holding demonstrations.
But according to the Jubilee MPs, Cord leaders are acting in violation of the law and ought to be stopped.
The case will be mentioned on May 26.
