City man detained by wife for two years wants title deed cancelled

An accountant who was rescued from a house where he had been detained by his wife for two years now wants the High Court to cancel a title deed issued in favour of two businessmen.

Mr Francis Kiongo Muturi wants the title deed issued to businessmen Mr Hitesh Morjaria and Mr Vijay Morjaria canceled because they allegedly breached the sale agreement.

Mr Muturi, 50, owned the Sh45 million land in Embakasi jointly with Mr Kennedy Ng’ang’a Maranga. They entered into a sale agreement with the two businessmen on the land in October 5, 2012.

He alleges in court papers that the two businessmen transferred the land, measuring one and half acres, into their names before they paid for it in full.

He argues that according to the sale agreement, the property was to be transferred to the businessmen after the full payment of Sh45 million.

SPECIALISED TREATMENT

He told Nairobi News that he is “selling the land to go for specialised treatment overseas.”

Mr Muturi contracted a mysterious disease when he was detained by his wife Ms Bertha Njeri in their matrimonial house in Kikuyu, Kiambu County, between 2013 and December 2015. He was eventually rescued by police, a local reverend and a lobby group for men’s rights.

In the case filed under a certificate of urgency Mr Muturi is asking the court to order the Chief Land Registrar of Titles at the Ministry of Lands to cancel the title registered in the names of Hitesh Morjaria and Vijay Morjaria.

He is further asking the court to revert back the land to him.

For the last three years the case has never been heard. When it came up last week, Justice Samson Okong’o who was scheduled to hear it was said to be on leave.

Mr Muturi has named Hitesh and Vijay as defendants in the case.
